Considering that the exploitation of unconventional resources has certain characteristics and effects that are sometimes distinct from the exploitation of conventional resources. In this paper, we study the requirements of utilization of these resources in the Persian Gulf. In this article, the requirements for the exploitation of unconventional resources were examined by looking at the Law of the Sea Convention 1982 and the Kuwait Regional Convention for the Protection of the Marine Environment against Pollution and its Protocols, in particular the Protocol on the Explosion and Disposal of Offshore Pollutants from the Continent. As a result of this study, it has been found that in terms of ownership and management of resources, no distinction has been made by the applicable international instruments. Furthermore, it has been suggested that while unconventional utilization of oil and gas recourses lead to disastrous environmental impacts, international law instruments generally applied the same approach for conventional and unconventional utilization. The Kuwait Convention, however, provides detailed rules and requirements which cover unconventional utilization of offshore oil and gas resources in a wider range.}, keywords = {Unconventional oil and gas resources,Exploitation of unconventional oil and gas resources,Environmental damage,Continental Shelf,Law of the sea Convention 1982,Kuwait Regional Convention}, title_fa = {بهره‌برداری از منابع نامتعارف نفت و گاز در خلیج فارس در پرتو الزامات کنوانسیون حقوق دریاها و کنوانسیون منطقه‌ای کویت}, abstract_fa = {بهره‌برداری از منابع غیرمتعارف نفت و گاز در آینده‌ای نه چندان دور و با کاهش بهره‌برداری از منابع متعارف از روند رو به گسترشی برخوردار خواهد گردید. نظر به اینکه بهره‌برداری از منابع غیرمتعارف دارای ویژگی‌ها و آثار گاه متمایزی نسبت به بهره‌برداری از منابع متعارف است، در این نوشتار به بررسی الزامات حاکم بر آن در منطقۀ خلیج فارس اقدام کرده‌ایم. در این مقاله، الزامات بهره‌برداری از منابع غیرمتعارف از رهگذر مقررات کنوانسیون‌های بین‌المللی و منطقه‌ای بررسی، و ملاحظه شد که کنوانسیون حقوق دریاها مصوب 1982 و کنوانسیون منطقه‌ای کویت در خصوص پاسداری از محیط زیست دریایی در برابر آلودگی‌ها و پروتکل‌های مربوطه، به‌ویژه پروتکل راجع به آلودگی دریایی ناشی از اکتشاف و استخراج از فلات قاره با توجه به جدید بودن این موضوع، به صراحت به آن نپرداخته است. با بررسی انجام‌شده مشخص شد که مقررات مندرج به طور کلی، به لحاظ مالکیت و مدیریت بر منابع از قابلیت اعمال برخوردار است، اما به لحاظ آثار زیست‌محیطی از کارآمدی لازم برای پوشش دادن آلودگی‌های زیست‌محیطی ناشی از اقدامات مذکور بهره‌مند نیست.}, keywords_fa = {بهره‌برداری از منابع نفت و گاز غیرمتعارف,خسارات زیست‌محیطی,فلات قاره,کنوانسیون حقوق دریاها 1982,کنوانسیون منطقه‌ای کویت,منابع غیرمتعارف نفت و گاز}, url = {https://jrels.ut.ac.ir/article_76496.html}, eprint = {https://jrels.ut.ac.ir/article_76496_ee580c1fc76c3cc63a75a6f59e92ee47.pdf} }
