Legal Implications of Corruption for Oil and Gas Contracts

Abstract

As a strategic commodity, oil and gas can pave the way for corrupt measures and undertakings in oil projects. This study conducts a case study to survey consequences of corrupt measures in a gas contract. The study begins by introducing a list of major sources of corruptions. It then analyses the related arbitral awards and court decisions to examine the validity of the main contract, the role of the substantive law and the law governing the arbitration. An attempt incorruption in comparison with substantive corruption in contracts, independence of the arbitration agreement, wrongful selection of the seat of arbitration, and impossibility of discontinuance of the proceedings, are among the issues discussed in section two of the paper. The study concludes with a list of strategies to battle corrupt measures in oil projects with a view to the local and international laws and regulations.
