In response to pandemics, many states implement preventive control measures to limit the spread of diseases, as well as protective measures aimed at safeguarding their national economies. Given the indefinite scope and duration of such measures, there is a potential for claims to be raised by foreign investors. Consequently, host states also seek defences under international law to counter these claims. This article examines whether the doctrine of state policy powers can serve as an effective defense for host states against foreign investors' claims. This doctrine posits that ordinary governmental actions taken in the interest of public welfare do not result in state liability.
