بررسی نقش قوانین رقابت انرژی در اتحادیة اروپا با تأکید بر حق دسترسی ثالث؛ مطالعة تطبیقی با قوانین ملی ایران

چکیده

این مقاله نقش قوانین مربوط به دسترسی شخص ثالث در ایجاد رقابت مؤثر در بازار انرژی اتحادیة اروپا و تأثیر قوانین رقابت اتحادیة اروپا بر امنیت انرژی در سراسر این اتحادیه را بررسی می‌کند. با توجه به وابستگی کامل بخش‌های گاز و برق به زیرساخت‌های انرژی در بازار انحصار طبیعی، دسترسی به زیرساخت‌های انرژی برای تقویت رقابت بدون تبعیض بسیار مهم است. افزون‌براین، نقش اصل همبستگی در امنیت انرژی و ارتباط آن با قوانین رقابت انرژی اتحادیة اروپا مورد ارزیابی واقع می‌شود. نتایج پژوهش حاضر نشان می‌دهد که قوانین رقابت اتحادیة اروپا نقش مهمی در تضمین عملکرد درست بازار آزاد انرژی دارند. همچنین با توجه به ابلاغ سیاست‌های کلی برنامة هفتم پیشرفت جمهوری‌اسلامی‌ایران درراستای اصلاح ساختار انرژی کشور، به نظر می‌رسد که کاربست تنظیم‌گری در حوزة حق دسترسی ثالث می‌تواند در بهبود امنیت انرژی کشور و حل بحران ناترازی راهگشا باشد.

چکیده [English]

This article examines the role of third-party access (TPA) laws in fostering effective competition within the EU energy market and the impact of EU competition laws on energy security across the Union. Given the complete reliance of the gas and electricity sectors on energy infrastructure in a natural monopoly market, access to such infrastructure is essential for ensuring non-discriminatory competition. Additionally, the role of the solidarity principle in energy security and its relationship with EU energy competition laws is evaluated. The findings reveal that EU competition laws contribute to effective market competition. Furthermore, considering Iran’s adoption of the general policies outlined in the Seventh Development Plan to reform its energy structures, implementing regulatory measures in the TPA domain appears to be a promising solution for enhancing the country’s energy security and addressing its energy imbalance crisis.
