تحلیل تاریخی- حقوقی موافقت‌نامۀ منابع هیدروکربن فرامرزی امریکا و مکزیک در خلیج مکزیک

چکیده

امریکا و مکزیک پس از چندین دهه مذاکره در 12 فوریۀ 2012 موفق به امضای موافقت‌نامه‌ای در خصوص نحوۀ بهره‌برداری از منابع نفت و گاز فرامرزی واقع در خلیج مکزیک شدند. یکپارچه‌سازی شیوه‌ای است که در موافقت‌نامه برای توسعه‌ و بهره‌برداری از منابع هیدروکربنی فرامرزی پیش‌بینی شده است. با توجه به شباهت تاریخی، ساختاری و حقوقی صنعت نفت مکزیک و ایران و میادین مشترک متعدد کشورمان با کشورهای همسایه، بررسی نحوۀ توافق امریکا و مکزیک به‌منزلۀ جدیدترین تلاش از این دست در سطح جهان می‌تواند در تبیین راهبردهای بخش انرژی کشور کمک‌های شایانی کند. درک متقابل، اعتماد‌سازی، ایجاد فرصت کافی برای گفتگو و مذاکره، رفع سوءتفاهم‌ها، مطالعۀ کامل ویژگی‌های زمین‌شناسی منطقه، دیدگاه بلندمدت، پرهیز از اقدامات یک‌جانبه و مهم‌تر از همه ایجاد منافع مشترک از جمله عوامل موفقیت دو کشور در دستیابی به توافق بود.

چکیده [English]

After decades of tough negotiations, U.S. and Mexico signed an agreement concerning Transboundary Hydrocarbon Reservoirs in the Gulf of Mexico on 12 Feb. 2012. Unitization is the approach that has been chosen by two countries to develop Gulf of Mexico's oil and gas transboundry resources. Due to legal, structural and historical similarities between Iranian and Mexican oil and gas industries, and existence of Iran's multiple transboundary hydrocarbon resources, assessment and analyzing of US-Mexico negotiations to know why they negotiated and how they could be able to handle their issues would be very helpful to Iran's oil and gas policy makers. Mutual understanding, providing enough time to talk and to do geological studies, enhancing historically faded confidence between two nations, avoidance of unilateral actions, long term approach and more importantly finding and generating common interests are the main success factors of two countries.
