بررسی چگونگی تشکیل نهادهای تنظیم مقررات انرژی در کشور با رویکرد تطبیقی

چکیده

به دلیل اهمیت راهبردی بخش انرژی، تنظیم مقررات این بخش جایگاه ویژه‌ای در میان کشورها دارد و نهادهای تنظیم مقررات نیز در همین خصوص تأسیس شده‌اند. مقالۀ حاضر در پی پاسخگویی به این پرسش است که چه نهاد یا نهادهایی وظیفۀ تنظیم مقررات بخش انرژی را بر عهده دارند و چه وظایف رگولاتوری برای آن‌ها مقرر شده است و در چه جایگاهی قرار گرفته‌اند. آیا تنظیم مقررات در بخش انرژی کشورها به عهدۀ نهاد واحدی است یا هریک از زیربخش‌های انرژی از طریق رگولاتوری جداگانه تنظیم می‌شوند. به‌منظور یافتن پاسخ، ابتدا نهادهای تنظیم مقررات بخش انرژی دیگر کشورها را مطالعه کردیم و با توجه به نتایج و مطابق با فرضیۀ وجود بسترهای قانونی لازم برای ابقا یا ایجاد نهادهای تنظیم مقررات بخش انرژی در کشور سناریوهایی برای تعیین جایگاه مطلوب نهادهای تنظیم مقررات بخش انرژی پیشنهاد خواهد شد.

چکیده [English]

Regulation is of special significance for countries due to strategic importance of energy sector. So, to address this issue, energy regulators have been established in many countries. This article responds to the question of what entity/entities can carry out energy regulatory functions, what are their legal statuses, and what are their corresponding responsibilities, and whether energy regulation is carried out by an individual regulator or multi-sector regulator. To respond the questions, energy regulators of some countries are studied, and, according to the results, and taking the presumption that the existence of the required legal infrastructure for establishment of energy regulator/s in Iran, some scenarios for appropriate legal status of energy regulators are proposed.
