خود‌تنظیمی زیست‌محیطی؛ مفهوم، مبانی و ابزارها (با نگاهی به حقوق ایران)

چکیده

خودتنظیمی زیست‌محیطی به‌عنوان ابزار نوین قاعده­گذاری زیست‌محیطی و در پاسخ به ناکارآمدی­های دولت در تنظیم مقررات مربوط به محیط ‌زیست شکل گرفت که با مبنا قرار دادن کثرت­گرایی و پذیرش اصل حسن­نیت و همکاری، قاعده‌مندسازی را به نهادهای خصوصی آلاینده واگذار­ می­کند. محیط ‌زیست مفهومی جهانی است و نمی‌توان قاعده­گذاری در این حوزه را به سطح کشورها محدود کرد. بنابراین، خودتنظیمی نیز براساس آن‌که در کشورها و توسط نهادهای ملی انجام شود یا در سطح بین‌المللی، اَشکال متفاوتی را ایجاد می­کند و دارای مزایا و معایب متفاوتی است، اما به دلیل ویژگی خاصی که در حوزۀ محیط‌ زیست مطرح است، معمولاً مزایای خودتنظیمی بیشتر و معایب آن با راه‌حل‌هایی قابل چشم­پوشی است. در مقالۀ پیش­رو تلاش شده است با تبیین مفهومی خودتنظیمی زیست‌محیطی و مزایا و معایب آن، روش نوین و مؤثرتری در قاعده­گذاری زیست‌محیطی و همچنین امکان اعمال آن در ایران مطرح گردد.

چکیده [English]

Environmental self-regulation was shaped by new tools of environmental legislation in response to government inefficiencies in regulating the environment, which, by incorporating pluralism and accepting the  vital principle of goodwill, regulated it to others. The global environment is global and cannot be limited to countries at this level. The use of self-regulation is also based on it in countries and by nine national diseases, or it creates different forms at the international level and has different advantages and disadvantages because there are more benefits to self-regulation in the region and there are also disadvantages. In this article, using the conceptual explanation of environmental self-regulation and its advantages and disadvantages, there is a new and more effective method in environmental law and also the possibility of applying it in Iran.
